The art of sculpture, like that of painting, took a new spring in this reign, but the early part of it was encumbered by the tasteless works of Wilton, Read, and Taylor. It remained for the genius of Banks, Nollekens, Bacon, Baily, Behnes, and Chantrey, to place sculpture on its proper elevation in England.The spring of 1810 witnessed one of the most important events of the reign of Napoleon, and one which, no doubt had a decided influence on his fatehis divorce from Josephine and his marriage with Maria Louisa, the archduchess of Austria. She proposed to him that he should adopt an heir, and she recommended to him her own son, Eugene Beauharnais. But this did not satisfy Buonaparte. She then turned his attention to a child of her daughter, Hortense Beauharnais, by his brother Louis, the King of Holland. This would have united her own family to his, and to this scheme Buonaparte appeared to consent. He showed much affection for the child, and especially as the boy displayed great pleasure in looking at arms and military man?uvres; and on one occasion of this kind Buonaparte exclaimed, "There is a child fit to succeed, perhaps to surpass me!" But neither was this scheme destined to succeed. The child sickened and died, and with it almost the last hope of Josephine. Whilst at Erfurt with the Emperor Alexander, in 1808, Buonaparte had actually proposed for a Russian archduchess; nay, in 1807 he had made such overtures at the Treaty of Tilsit. Thus the idea had been settled in his mind three years, at least, before it was realised. The Russian match had on both occasions been evaded, on the plea of the difference of religion; but the truth was that the notion of such an alliance was by no means acceptable to the Imperial family of Russia. The Empress and the Empress-mother decidedly opposed it; and though the plea of difference of religion was put forward, Buonaparte could not but feel that the real reasons were very differentthat he was looked on as a successful adventurer, whose greatness might some day dissolve as speedily as it had grown, and that, be this as it might, the Russian family were not disposed to receive him, a parvenu monarch, into their old regal status.To all this his Lordship had to add various specimens of the Canons. By the 3rd, every one asserting that the Church of England was not a true apostolical church should be excommunicated. The 4th and 5th excommunicated all who declared that there was anything contrary to sound Scripture in the form of worship of the Church of England, or anything superstitious or erroneous in the Thirty-Nine Articles. The 65th enjoined all ordinaries to see that all offenders, under the different Acts here enumerated, should be cited and punished according to statute, or excommunicated. The 72nd forbade, under pain of excommunication, all ministers, without licence of the bishop, to attempt, upon any pretence whatever, to cast out any devil or devils, under pain of deposition from the ministry. The 73rd made it a subject of excommunication that any priest or minister should meet with other persons in any private house or elsewhere to consult upon any canon, etc., which may tend to impeach or deprave the doctrine, the Book of Common Prayer, or any part of the discipline and government of the Church of England; and by the 115th, all churchwardens are enjoined to make presentments of offenders in any of these particulars; and all judges, magistrates, etc., are bound to encourage, and not to discourage, all such presentments. Lord Stanhope observed that the Court of King's Bench, in 1737, had decided that these Canons, not having ever received the sanction of Parliament, were not binding on the laity; and he contended that the ratification of them by James I., not being authorised by the original statute, the 25th of Henry VIII., made them as little binding on the clergy. He had not, therefore, included the Canons in his Bill. He took care, too, to except Catholics from the benefit of the Bill; neither was the Bill to repeal any part of the Test and Corporation Acts, nor the 12th and 13th of William III., "for the better securing the rights and liberties of the subject." He finally showed that these fierce[163] and persecuting Acts were not become utterly obsolete; they were ever and anon revived, and might, any of them, be acted upon at any moment. It might reasonably have been supposed that the bishops would have supported the Bill unanimously; that they would have been glad to have all such evidences of the odious means by which their Church had been forced on the people, swept out of the Statute-book and forgotten. No such thing. The Archbishop of Canterbury declared, if Dissenters were allowed to defend their principles, the atheist and the theist might be allowed to defend theirs. But Bishop Horsley, then of St. David's, was the chief speaker against the repeal of these precious laws. He declared that this repeal would level every bulwark of the Church; that "the Christian religion would not remain in any shape, nor, indeed, natural religion!" It is needless to say that the Bill was rejected; it could not attain even to a second reading.<024>

It announced that his Majesty had suffered for some time from an affection of the chest, which had produced considerable[415] weakness. The burden of regal state, assumed at so late a period of life, seemed to have been too much for his strength, and to have caused too great a change in his habits. In the preceding month of April his eldest natural daughter, Lady De Lisle, died, and also the queen's mother, the Dowager Duchess of Meiningen. These events made a deep impression upon his mind, which acted upon his enfeebled constitution and aggravated the symptoms of his disease. From the 9th of June, when the first bulletin was issued, he grew daily worse; the circulation became more languid, and the general decay more apparent. On the 20th of June he expired, in the seventy-third year of his age, having reigned nearly seven years. His kindness of heart and simplicity of character, which had endeared him greatly to all classes of his subjects, caused him to be generally and sincerely lamented. In the House of Peers Lord Melbourne referred to his death as a loss which had deprived the nation of a monarch always anxious for the interest and welfare of his subjects; and added, "which has deprived me of a most generous master, and the world of a manI would say one of the best of mena monarch of the strictest integrity that it has ever pleased Divine Providence to place over these realms. The knowledge which he had acquired in the course of his professional education of the colonial service and of civil matters, was found by him exceedingly valuable, and he dealt with the details of practical business in the most familiar and most advantageous manner. A more fair or more just man I have never met with in my intercourse with the world. He looked upon the second Melbourne Cabinet as forced upon him, and, though he had regard for one or two of themparticularly Lord Melbourne and Lord Palmerstonhe made no secret of his dislike to the whole, and never invited them to Windsor. We have already given an instance of one of his discreditable outbursts, and his conduct during his later years was in other respects eccentric in the extreme. Besides, his zeal for reform had long passed away; and he was in complete sympathy with the factious proceedings of the majority of the House of Lords when each Ministerial measure was proposedfor instance, the Church Rates Bill he met with a long and ably argued list of objections which it required all Lord Melbourne's tact and firmness to overcome. But, with all his oddities and faults, William IV. was a thoroughly honourable man, and his opposition to his Ministers entirely aboveboard.

THREE:Argyll, who received the news of the retreat about four in the afternoon of that day, occupied Perth with Dutch and English troops by ten o'clock the next morning. They had quitted Stirling on the 29th, and that night they encamped on the snow amid the burnt remains of the village of Auchterarder. Argyll and Cadogan followed the advanced guard and entered Perth on[32] the evening of the 1st of February; but the remainder of the troops did not arrive till late at night, owing to the state of the roads and the weather. Some few of the rebels, who had got drunk and were left behind, were secured. The next day Argyll and Cadogan, with eight hundred light foot and six squadrons of dragoons, followed along the Carse of Gowrie to Dundee. Cadogan, in a letter to Marlborough, complained of the evident reluctance of Argyll to press on the rebels. When he arrived at Dundee on the 3rd, the rebel army was already gone. He and Cadogan then separated, taking different routes towards Montrose. Cadogan, whose heart was in the business, pushed on ahead, and on the 5th, at noon, reached Arbroath, where he received the news that the Pretender had embarked at Montrose and gone to France. In this manner did the descendant of a race of kings and the claimant of the Crown of Great Britain steal away and leave his unhappy followers to a sense of his perfidious and cruel desertion. His flight, no doubt, was necessary, but the manner of it was at once most humiliating and unfeeling. The consternation and wrath of the army on the discovery were indescribable. They were wholly broken up when Argyll reached Aberdeen on the 8th of February.

He moved that the House should take the question of privilege into immediate consideration. On the other hand, Lord North, who was a member of the Treasury board, and Sir Fletcher Norton, Attorney-General, put in the depositions of the printer and publisher, proving the authorship of No. 45 of the North Briton on Wilkes, and pressing for rigorous measures against him. A warm debate ensued, in which Pitt opposed the proceedings to a certain extent, declaring that he could never understand exactly what a libel was.[181] Notwithstanding, the Commons voted, by a large majority, that No. 45 of the North Briton was "a false, scandalous, and malicious libel," tending to traitorous insurrection, and that it should be burnt by the common hangman.

THREE:On the 12th of February, 1823, the President of the Board of Trade said, in his place in Parliament:"The general exports of the country in the four years from 1815 to 1819 had decreased 14,000,000 in official value; and he took the official value in preference to the declared, because it was from the quantity of goods produced that the best measure was derived of the employment afforded to the different classes of the community. In the year from the 5th of January, 1819, to the 5th of January, 1820, the exports of the country fell off no less than 11,000,000; and in looking at that part of it which more completely embraced British or Irish manufacture, he found that the difference in four years was 8,414,711; and that in the year from the 5th of January, 1820, to the 5th of January, 1821, there was a decrease of 8,929,629. Nobody, therefore, could be surprised that, at that period, the industry of the country appeared to be in a state of the utmost depression; that our manufacturers were most of them unemployed; that our agriculturists were many of them embarrassed; and that the country, to use the phrase of a friend of his in presenting a petition from the merchants of London, 'exhibited all the appearances of a dying nation.' Though the condition of the agricultural interest was not as favourable as he could wish, still it was most satisfactory for him to state that not only did the exports of last year [1822] exceed those of all the years to which he had been alluding, but also those of the most flourishing year which had occurred during the continuance of the war. In all material articles there had been a considerable increase. The export of cotton had increased ten per cent., and hardware seventeen per cent.; of linens twelve per cent., and of woollens thirteen per cent.; and the aggregate exports of 1822 exceeded those of 1820 by twenty per cent., and of 1821 by seven per cent., notwithstanding a deduction was to be made from the exports of one great article, sugar, owing to a prohibitory decree of Russia, amounting to thirty-five per cent." The result of this prosperous state of things was that, in 1823, the new Chancellor of the Exchequer was enabled to present the best and most popular Budget that had been laid before Parliament for many years, remitting a large amount of taxes that had pressed most heavily on the springs of industry, and inflicted the greatest amount of inconvenience and privation upon the people. The revenue of the nation in that year was 57,000,000, and the expenditure was estimated at 49,672,999, leaving a surplus of upwards of 7,000,000. Of this surplus, 5,000,000 was set aside for the reduction of the National Debt, and the remainder for the remission of taxes. As the assessed taxes were most oppressive, they were reduced fifty per[239] cent., a reduction which was estimated on the window tax alone at 1,205,000. On the whole, the assessed taxes were reduced by 2,200,000. This included 100,000, the total amount of assessed taxes in Ireland. In England the whole of the window tax was removed from the ground floors of shops and warehouses.

THREE:Before Buonaparte quitted Erfurt he learned that his late allies, the Bavarians, with a body of Austrians under General Wrede, were marching to cut off his line of retreat to the Rhine, and that another body of Austrians and Prussians were marching from near Weimar, on the same point, with the same object. He left Erfurt on the 25th of October, amid the most tempestuous weather, and his rear incessantly harassed by the Cossacks. He met Wrede posted at Hanau, but with only forty-five thousand men, so that he was able to force his way, but with a loss of six thousand, inflicting a still greater loss on the Austro-Bavarians, of nearly ten thousand. On the 30th of October Napoleon reached Frankfort, and was at Mainz the next day, where he saw his army cross, and on the 7th of November he left for Paris, where he arrived on the 9th. His reception there was by no means encouraging. In addition to the enormous destruction of life in the Russian campaign, the French public nowinstead of the reality of those victories which his lying bulletins had announcedsaw him once more arrive alone.

THREE:In the meantime, coroners' inquests had been held on the two men who were shot by the military. In the one case the jury brought in a verdict of "justifiable homicide;" but, in the other, of "wilful murder" against the soldiers. On their part, the Government offered a reward of five hundred pounds for the discovery of any one who had been guilty of firing at the soldiers, and an additional one of five hundred pounds for the discovery of the person who had fired at and wounded Ensign Cowell, whilst on duty at the Tower, the night after the committal of Sir Francis. The Reform party in the Commons demanded whether the Government did not intend to offer a reward for the discovery of the soldiers who had fired at and wounded several of the people, and killed two of them. Whitbread moved that an inquiry should be instituted into the justice of the verdict of "wilful murder" against the soldiers, and in this he was seconded by William Smith of Norwich; but Captain Agar, who had been on duty, declared that the people had fired the first shot, and the Premier got rid of the question by asserting that an inquiry was already going on into the circumstances of the riot, and that it was not for Parliament to anticipate it.

ONE:There were rumours of negotiations going on for a return of Pitt to power; but as Mr. Addington showed no disposition to resign altogether in favour of Pitt, these came to nothing. Already in the previous November Canning and Lord Malmesbury, two of Pitt's most zealous supporters, had set on foot an address to Addington begging him to resign. But this plan was abruptly stopped by Pitt himself, who felt that he was to a certain extent the creator of the Ministry. Now Addington made overtures to Pitt through Dundas, become Lord Melville. But his propositions were absurd. He stipulated that Greville and Windham, who had opposed the Peace of Amiens, should be excluded from the arrangements. He also wished that Pitt's brother, Lord Chatham, should be the nominal Prime Minister, while he and Pitt should be equal secretaries. At this, Pitt put a stop to the envoy's conversation. "Upon my word," he said afterwards, "I had not the curiosity to ask what I was to be." So England engaged in war, with her greatest statesman excluded from office.Had Sir Home Popham been satisfied with this well-executed piece of service, he would have merited honour; but, this being done, he suggested to Sir David Baird that an expedition might be made with advantage against the Spanish colonies in South America. It was reportednot truly, as it turned outthat these colonies were as poorly defended as they were wealthy. Sir David was weak enough to fall into the scheme, and, without any authority from home, as it would appear, for so important a proceeding, he permitted General Beresford to sail in Sir Home's squadron with a part of his forces. The fleet touched at St. Helena, and took in a few more soldiers, but the whole body did not then amount to more than sixteen hundred. With this contemptible handful of men, the British squadron entered the river La Plata, and landed the troops, on the 24th of June, at a short distance from Buenos Ayres. The few Spanish troops in the city were easily routed, and the place capitulated on the 27th, and Beresford entered and took up his quarters there. But he was not long left at peace. The Spaniards discovering, as a matter of course, the insignificance of the force which had thus rashly surprised the city, collected in sufficient numbers to make prisoners of them all. A French officer in the Spanish service, M. Liniers, landed with a thousand men from Monte Video and Sacramento, and, being joined by the troops of the neighbourhood which had been repulsed by Beresford, appeared before the city on the 10th of July, and summoned the British to surrender. This was the signal for the inhabitants to rise en masse and fall on them. They were prevented from escaping to their ships by the badness of the weather, and were assailed from the windows and doors, and exposed to a general attack in the great square, and were compelled to yield, on condition of being allowed to re-embark; but no sooner had they laid down their arms, than Liniers, who probably looked on them as no better than filibusters, treated them as such, and marched them up the country, where they were rigorously treated. Four hundred of them had perished in this mad attempt. Meanwhile, Sir Home Popham had sent home upwards of a million of dollars, reserving two hundred and five thousand for the pay of the army. There were great rejoicings in London at the news, and at the receipt of the specie. Popham, in his despatches, represented himself as having conquered a great colony, and opened up a wonderful mart for our manufactures; and the Ministry, delighted at the receipt of the dollars, though they had, on first hearing of the scheme, sent out orders to stop the squadron, now, on the 20th of September, issued an Order in Council declaring Buenos Ayres and its dependencies open to our trade. Long before this order could have reached America the whole scene was reversed. Sir Home Popham had, indeed, blockaded the river La Plata, and had attempted to bombard Monte Video, but his ships could not get near enough. In October reinforcements arrived from the Cape and from England, but not in sufficient strength to enable him to do anything decisive. He therefore contented himself with landing troops at Maldonado, and drove the Spaniards from the isle of Gorriti, where he lay to, and waited for greater reinforcements.

TWO:Meanwhile by the advice of Bute the king sent for Pitt. On the 27th of August he had an audience of the king at Buckingham House. Pitt, however, insisted on having in with him all, or nearly all, his old colleagues, and this was too much for the king; whilst not to have had them would have been too little for Pitt, who was too wise to take office without efficient and congenial colleagues. The king, nevertheless, did not openly object, but allowed Pitt to go away with the impression that he would assent to his demands. This was Saturday, and Pitt announced this belief to the Dukes of Devonshire and Newcastle, and the Marquis of Rockingham. But on Sunday Grenville had had an interview with the king, and finding that he considered Pitt's terms too hard, had laboured successfully to confirm him in that opinion. Accordingly, on Monday, at a second meeting, the king named the Earl of Northumberland, Lord Halifax, and George Grenville, for leading posts in the Cabinet, saying, "Poor George Grenville, he is your near relation, and you once loved him." Pitt said that it would not do, bowed and retired; the king saying, "My honour is concerned, and I must support it."On his return Lord Cochrane received the honour of the red riband of the Bath; but he could not conceal his dissatisfaction at Lord Gambier's conduct, and declared that he would oppose any vote of thanks to him in Parliament. On this, Gambier demanded a court-martial, which was held, and acquitted him of all blame. Cochrane complained that the court was strongly biassed in favour of Gambier, and against himself, and the public was very much of his opinion.

The military contingents which he exacted from them amounted to sixty thousand men, and these he soon had in a state of discipline and efficiency very different to that which they exhibited under the old German federation. Under Napoleon they behaved as well as any of his troops, showing that they needed only leaders of activity and talent to make good soldiers of them. Thus France superseded Austria in its influence over all the south-west of Germany. Nor did he stop here. He had created dukes and princes, and resolved also to create kings. These were to be his brothers, who were to be placed on half the thrones of Europe, and set there as vassal monarchs doing homage and service to him, the[524] great emperor of France. He expected them to be the obedient servants of France, or, rather, of himself, and not of the countries they were ostensibly set to govern. He began by making his brother Joseph King of Naples in March, and in June he made his brother Louis King of Holland. He told them that they must never forget that their first duty was to France and to himself. He intended to make his brother Jerome King of Westphalia; but Jerome had married a Miss Paterson, the daughter of an American merchant, and he must have this marriage broken, and a royal one arranged, before he could admit him to this regal honour: he must also wrest part of this territory from Prussia. His sister Pauline, widow of General Leclerc, who perished in St. Domingo, he had now married to the Roman Prince Borghese, and he gave her the Italian duchy of Guastalla. Murat, who had married another sister, he made Grand Duke of Berg and Cleve, and Marshal Berthier he made Prince of Neuchatel. These territories, taken from Prussia, Bavaria, and Switzerland, he conferred, with all their rights and privileges, on these generals. The duchy of Parma he conferred on Cambacrs, and Piacenza on General Lebrun.Our forces on the Italian coast were met by the active spirit of the new King of Naples, Joachim Murat. Sir John Stuart, who had won the splendid victory of Maida, embarked, on the 13th of June, fifteen thousand British troops in Sicily, and proceeded to menace Naples, and create alarm in various quarters, so as to draw the French from Upper Italy, and thus relieve the Austrians. With part of these forces siege was laid to Scylla; with the other Sir John anchored off Cape Miseno, close to Bai? and Puzzuoli, and directly across the bay, about a dozen miles from Naples. The greatest alarm was excited, and nothing would have been easier for Sir John than to have battered the town about the ears of the intruder king; but this the interests of the old king did not permit, especially as Ferdinand's second son, Don Leopold, was present as nominal commander, but he was of no use really, being a most effeminate and incapable person. Sir John then sailed to the islands of Procida and Ischia, compelled the garrisons to capitulate, dismantled the fortifications, and then abandoned these islands. During all this time our warships were scouring the whole of the coasts of Southern Italy, capturing every vessel that ventured out, and keeping the French generals on shore in constant agitation. In the encounters with the enemy's vessels on these coasts many brilliant exploits were performed by our captains, and by none more than by Captain Staines, of the Cyane frigate, who, on the 27th of June, stood a stout but most unequal fight with a Neapolitan frigate and corvette, under the very batteries of Naples. The siege of Scylla was raised by a strong French force, and Sir John Stuart returned to Sicily. Scylla was, however, shortly after abandoned again by the French, and its guns and stores, which appeared to have been left in some panic, fell into the hands of the British.

Mr. Sturges Bourne obtained the passing of his long-advocated Poor Law Bill; but Bills for regulating settlements, and for preventing the misapplication of the poor rates, were thrown out. A Bill was passed to regulate the treatment of children in cotton factories, and to limit the hours of their employment. Mr. Brougham's Act for inquiry into the charitable foundations of England was extended, with the support of Government, so as to apply to educational as well as to all kinds of charities, except such as had special visitors, or were maintained by private subscriptions. Sir James Mackintosh also took up the humane track of labour occupied so nobly by the late Sir Samuel Romilly. On the 2nd of March he moved for the appointment of a select committee to take into consideration the subject of capital punishment as regarded felonies. Government, as if to wipe out their disgrace in resisting so humane a measure, now proposed an inquiry into the condition of gaols and other places of confinement, and into the best method of employing and reforming delinquents during their imprisonment. Some reforms were made in Scottish law. The old rights of trial by battle, and of appeals of murder, felony, or mayhem, were abolished as rendered unnecessary by the full exercise of the institution of jury, and as belonging only to a barbarous age. The severity of the Scottish law against duels was mitigated, that law pronouncing forfeiture of all movable property, and banishment against all persons sending, or even carrying, a challenge to fight a duel. The principle of that law was sound, but its severity was its own defeat. A more questionable Bill was one carried, after much opposition, called the Foreign Enlistment Bill, which was intended to check the aid of Englishmen in assisting the Spanish South American colonists in throwing off the oppressive government of the mother country. Numbers of Englishmen were engaged on the side of independence, and this Bill was vainly intended to put an end to that generous aid.The year 1824 is memorable in Ireland for the establishment of the Catholic Association. The Catholic question had lain dormant since the union. Ireland remained in a state of political stupor. There was a Catholic committee, indeed, under the direction of a gentleman of property, Mr. John Keogh, of Mount Jerome, near Dublin. But his voice was feeble, and seldom heard. The councils of the Roman Catholics were much distracted. Many of the bishops, and most of the gentry, recommended prudence and patience as the best policy. Liberal statesmen in England were willing to make concessions, but the conscientious scruples of George III. had presented an insuperable barrier in the way of civil equality. There was an annual motion on the subjectfirst by Grattan, then by Plunket, and lastly by Burdett; but it attracted very little attention, till the formidable power of the Catholic Association excited general alarm for the stability of British institutions. Adverting to the past history of Irelandher geographical position, her social state in respect of the tenure of property, and the numbers of the respective religious denominations of her peoplethe ablest Conservative statesmen considered that it would be extremely difficult to reconcile the perfect equality of civil privilege, or rather the bona fide practical application of that principle, with those objects on the inviolable maintenance of which the friends and opponents of Catholic Emancipation were completely agreednamely, the Legislative union and the Established Church. There was the danger of abolishing tests which had been established for the express purpose of giving to the legislature a Protestant charactertests which had been established not upon vague constitutional theories, but after practical experience of the evils which had been inflicted and the dangers which had been incurred by the struggles for ascendency at periods not remote from the present. There was the danger that the removal of civil disabilities might materially alter the relations in which the Roman Catholics[249] stood to the State. Sir Robert Peel, in his "Memoirs," recites those difficulties at length, and in all their force. He fully admits that "the Protestant interest" had an especial claim upon his devotion and his faithful service, from the part which he had uniformly taken on the Catholic question, from the confidence reposed in him on that account, and from his position in Parliament as the representative of the University of Oxford.[See larger version]
